Terms of Service

The guidelines and terms for using CWSA platforms and services.

These Terms of Service ("Terms") govern your access to and use of Competitive Wake Surf Association, Inc. ("CWSA", "we", "us", and "our") websites, portals, applications, event systems, and related services (collectively, the "Services"). By using the Services, you agree to these Terms.

1. Eligibility and Account Responsibility

  • You must provide accurate information and keep your account details current.
  • You are responsible for maintaining the confidentiality of account credentials.
  • You are responsible for all activity that occurs under your account, unless unauthorized use is promptly reported.
  • We may require additional verification for security, compliance, or operational purposes.

2. Services Covered

Services may include memberships, event registrations, seminar registrations, rankings, scoring systems, content systems, communication tools, and role-based portals (including board, event organizer, national organization, and athlete/member workflows).

3. Memberships, Registrations, and Payments

  • Memberships and registrations may be subject to eligibility rules, deadlines, and capacity limits.
  • Fees, invoices, and payment timelines are displayed in the relevant Service flow or invoice records.
  • Payment processing may be handled by third-party providers such as Stripe.
  • Refunds, transfers, cancellations, and credits are governed by applicable CWSA and event policies.
  • Chargebacks or payment disputes may result in account or registration restrictions pending resolution.

4. Competition, Scoring, and Rankings

  • Competition participation is subject to current CWSA rules, published criteria, and event-specific policies.
  • Scoring and ranking outputs are based on the data and rules in effect at the time of processing.
  • CWSA may correct clerical, processing, or data integrity errors where necessary to preserve fair and accurate official records.
  • Official competition and ranking decisions remain subject to CWSA governance and dispute procedures where applicable.

5. Acceptable Use

You agree not to:

  • Use the Services in violation of law, regulations, or CWSA policies.
  • Interfere with platform security, performance, or availability.
  • Submit false, misleading, or unauthorized data.
  • Attempt unauthorized access to accounts, systems, APIs, or restricted records.
  • Use bots, scripts, scraping, or automation in ways not expressly authorized by CWSA.
  • Harass, abuse, threaten, or impersonate other participants, staff, judges, organizers, or volunteers.

6. User Content and Submissions

You may submit data, forms, profile content, media, messages, and related materials through the Services ("User Content"). You represent that you have the rights necessary to submit that content. You grant CWSA a non-exclusive, worldwide, royalty-free license to use User Content as needed to operate, administer, and improve the Services, including competition and operational workflows.

7. Intellectual Property

The Services, including platform design, branding, software, and content (excluding User Content), are owned by CWSA or its licensors and are protected by applicable intellectual property laws. No ownership rights are transferred by your use of the Services.

8. Third-Party Services

The Services may link to or integrate with third-party tools and platforms, including payment processors, email providers, analytics, streaming, and social platforms. CWSA is not responsible for third-party terms, content, availability, or practices.

9. Suspension and Termination

We may suspend or terminate access to all or part of the Services if you violate these Terms, applicable policies, or legal requirements, or if necessary for security, platform integrity, or operational reasons.

10. Disclaimers

Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. CWSA disclaims warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, CWSA and its officers, directors, volunteers, staff, and affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenues, data, or goodwill arising from or related to the Services. Aggregate liability for direct damages will not exceed amounts paid by you to CWSA for the specific Service giving rise to the claim in the twelve (12) months before the claim, unless otherwise required by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless CWSA and its officers, directors, volunteers, staff, and affiliates from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or violation of rights of another party.

13. Governing Law and Disputes

These Terms are governed by applicable United States and state law, without regard to conflict-of-law principles, except where mandatory law provides otherwise. You agree to work in good faith with CWSA to resolve disputes before initiating formal proceedings.

14. Changes to Terms

We may update these Terms periodically. Changes are effective upon posting. Continued use of Services after updates means the revised Terms are acknowledged and agreed to.
